Terms and Conditions
Please read these Terms and Conditions carefully; they become effective upon your enrollment in the SMS program of Knight Transportation, Inc. (“Knight” or “Company). By checking the opt-in box and completing this short form inquiry, you expressly consent and provide written authorization to receive non-marketing and marketing communication from Knight, including text messages and telephone calls, using autodialer and non-autodialer technology, at your provided mobile phone number(s) or emails at your provided email address(es) as associated with this short form inquiry. If you do not agree to these Terms and Conditions, do not give your consent to receive messages or follow the instructions below to stop the messages.
You may opt-out of these communications at any time by replying [STOP] to any text message from Knight or by otherwise contacting Knight as indicated below. You can receive help at any time by replying [HELP] to any text message from Knight or by otherwise contacting Knight as indicated below. You do not have to opt-in or agree to the terms of opt-in as a condition of purchase, nor does consent to receive non-marketing or marketing text messages require purchase of any products or services from Knight. Messaging and data rates may apply.
“You” means the person or entity who participates in or uses the SMS service in any way. “Knight,” “we,” “our,” “us,” and “Company” means Knight Transportation, Inc., as well as any other person or entity providing any service, applications or content from us or on our behalf.
Company and its service providers may use an automatic telephone dialing system (“autodialer”) to deliver Company text messages to you. Company text messages are intended to provide you with information about Knight’s goods and services.
The number of Company text messages that you receive will vary depending on how many of Company’s text messaging programs for which you sign up to receive messages.
Message and data rates may apply to each text message sent or received in connection with Company text messages, as provided in your mobile telephone service rate plan (please contact your mobile telephone carrier for pricing plans), in addition to any applicable roaming charges. Company does not impose a separate fee for sending Knight text messages.
Supported carriers may change from time to time, but currently include AT&T, T-Mobile, Verizon Wireless, Sprint, among others. Current carriers may be terminated and additional carriers may be added without notice.
How to Opt-In
To opt-in to receive text messages from a Company text messaging program(s), please check the opt-in box at the bottom of the short form inquiry.
How to Opt-Out
You are responsible for managing the types of SMS text messages you receive. To stop receiving text messages from Knight’s SMS program, by replying [STOP] to any text message from Knight or by otherwise contacting Knight at 1-888-4KNIGHT or email@example.com.
Mobile Telephone Number
You represent that you are the account holder for the mobile telephone number(s) that you provide. You are responsible for notifying Company immediately if you change your mobile telephone number. You may notify Company of a number change by submitting a revised short form referencing the previous number on the face of the revised short form inquiry.
You agree to indemnify Company in full for all claims, expenses, and damages related to or caused in whole or in part by your failure to notify Company if you change your telephone number, including, but not limited to, all claims, expenses, and damages related to or arising under the Telephone Consumer Protection Act.
Access or Delivery to Mobile Network is Not Guaranteed
Delivery of information and content to a mobile device may fail due to a variety of circumstances or conditions. You understand and acknowledge that network services, including but not limited to mobile network services, are outside of Knight’s control, and Company is not responsible or liable for issues arising from them.
Disclaimer of Warranties
TO THE EXTENT PERMITTED BY LAW, WE MAKE NO REPRESENTATIONS OR WARRANTIES REGARDING THE SERVICE, APPLICATIONS OR CONTENT THAT YOU RECEIVE FROM US, AND DISCLAIM ANY WARRANTIES OR REPRESENTATIONS, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR USE. THIS SERVICE OFFERED TO THE PUBLIC BY PROVIDER COULD INCLUDE INACCURACIES, OTHER ERRORS OR MAY NOT FUNCTION IN THE MANNER YOU ANTICIPATED. FURTHERMORE, WE ARE NOT RESPONSIBLE FOR CIRCUMSTANCES BEYOND OUR CONTROL, INCLUDING, WITHOUT LIMITATION, ACTS OR OMISSIONS OF OTHERS, ATMOSPHERIC CONDITIONS OR ACTS OF GOD. WE DO NOT PROMISE ERROR-FREE SERVICE. WE WILL NOT BE LIABLE FOR ANY DELAYS IN THE RECEIPT OF ANY SMS MESSAGES AS DELIVERY IS SUBJECT TO THE EFFECTIVE TRANSMISSION FROM YOUR NETWORK OPERATOR.
You are responsible for managing the types of SMS text messages you receive. To request more information, you can receive help at any time by replying [HELP] to any text message from Knight or by otherwise contacting Knight at 1-888-4KNIGHT or firstname.lastname@example.org.
To receive Company text messages, you must be a resident of the United States and 18 years of age or older. Company reserves the right to require you to prove that you are at least 18 years of age.
Changes to Terms and Conditions
Company may revise, modify, or amend these SMS Terms and Conditions at any time. Any such revision, modification, or amendment shall take effect when it is posted to Knight’s website. You agree to review these SMS Terms and Conditions periodically to ensure that you are aware of any changes. Your continued consent to receive Company text messages will indicate your acceptance of those changes.
Termination of Text Messaging
Knight may suspend or terminate your receipt of Company text messages if Company believes you are in breach of these SMS Terms and Conditions. Your receipt of Company text messages is also subject to termination in the event that your mobile telephone service terminates or lapses. Knight reserves the right to modify or discontinue, temporarily or permanently, all or any part of Company text messages, with or without notice.
Communications and Consent to Electronic Notices
You may communicate with Company via postal mail, telephone, and our website. Company may issue notices via these various channels, including by sending e-mail to an address you provide. You agree that such notices shall have legal effect. You also agree that notices sent by e-mail satisfy any requirement that notices be provided in writing. If you do not agree, do not use Company products or services. You may have the right to withdraw your consent to receive certain electronic communications, and, when required by law, Knight will provide you with paper copies upon request.
To receive, access, and retain the notices that Company sends via e-mail, you must have Internet access and a computer or device with a compatible web browser. You will also need software capable of viewing files in PDF format. Your device or computer must have the ability to print, or download and store, e-mails and PDF files. By accepting these terms, you confirm that you are able to receive, access, and retain the notices that Company may send.
Limitation of Liability
Knight is not responsible and will not be liable for any damages of any nature, including without limitation any incidental, special or consequential damages (such as lost profits or lost business opportunities), punitive damages or attorney’s fees arising from its SMS program.
Your use of the SMS program under this Agreement is governed by the laws of the state of Arizona. You agree to the exclusive jurisdiction of the state of federal courts located in Maricopa County, Arizona.
